Extra Happy Taps Competition Terms and Conditions.

1. Promoter

The Extra Happy Taps Creator Competition ("Competition") is promoted by Westpac New Zealand Limited ("Westpac", "we", "our" or "us").

These terms and conditions apply only to the Extra Happy Taps Competition and are separate from the Happy Taps Promotion.

Participation in the Competition constitutes acceptance of these terms and conditions.

2. Competition Period

The Competition will be conducted during the dates and times specified by Westpac and/or participating content creators on their social media channels.

Westpac reserves the right to amend, postpone, suspend or cancel any Competition event where necessary, including due to safety, operational, weather, technical or other unforeseen circumstances.

3. Eligibility

To be eligible to win a prize, a participant must:

a) be aged 18 years or over;

b) ordinarily reside in New Zealand;

c) be a current Westpac customer at the time of winner verification;

d) hold an eligible Westpac debit card or credit card; and

e) comply with these terms and conditions.

Employees of Westpac, participating agencies and any businesses directly involved in administering the Competition, and their immediate family members, may not enter.

4. No Purchase Necessary

No purchase, payment, banking transaction, or spend is required to participate in or win the Competition.

A participant's chances of winning are not increased by using, spending on, or transacting with a Westpac card.

The Competition is a promotional prize activity and does not involve gambling.

5. How to Participate 

Eligible participants may participate by:

a) following clues published by participating content creators and/or Westpac;

b) locating the designated Extra Happy Taps activation location; and

c) following the instructions provided at the activation location.

Participants must travel safely and lawfully at all times.

Participants must not:

• trespass;
• enter restricted or unsafe areas;
• use a mobile phone while driving;
• drive recklessly;
• run through traffic or unsafe environments; or
• engage in behaviour that could endanger themselves or others.

Westpac may disqualify any participant who breaches these requirements.

6. Determining the Provisional Winner

Each Competition event will have one provisional winner.

Unless otherwise stated, the provisional winner will be the first eligible participant to:

a) arrive at the designated activation location;

b) correctly provide the secret phrase or code phrase associated with that Competition event.

Where multiple participants arrive at substantially the same time, Westpac's determination of the first participant to satisfy the winning requirements will be final.

Westpac may use timestamps, observations from event personnel and other available evidence to determine the provisional winner.

7. Winner Verification 

A provisional winner is not a confirmed winner until eligibility has been verified by Westpac. 

Verification may be undertaken by a dedicated Westpac team member, through a dedicated phone line, at a Westpac branch, or through another verification process nominated by Westpac. 

Westpac may require reasonable evidence to confirm eligibility, including: 

• identity; 
• age; 
• New Zealand residency; 
• holder of an eligible Westpac debit or credit card; and 
• an account suitable for payment of the prize.

Participants should not provide card numbers, PINs, internet banking passwords or other security credentials. 

If a provisional winner: 

• cannot be contacted; 
• does not complete verification within the timeframe specified by Westpac; 
• provides incomplete or incorrect information; 
• is unable to satisfy the eligibility requirements; or 
• is otherwise found to be in breach of these terms, 

Westpac may disqualify that person and select another provisional winner. 

8. Prize 

The prize for each Competition event is NZD $1,500. 

The prize: 

• is not transferable; 
• cannot be exchanged for another product or benefit; and 
• will be paid only after winner verification has been successfully completed. 

Westpac may pay the prize into a New Zealand Westpac bank account nominated by the confirmed winner. 

9. Redraws and Replacement Winners 

If a provisional winner is disqualified or fails verification, Westpac may determine an alternative provisional winner using the same competition process or any other reasonable method determined by Westpac. 

This process may be repeated until an eligible winner is verified. 

10. Photography, Filming and Publicity 

Competition events may be photographed, filmed or otherwise recorded. 

Participants attending a Competition location acknowledge they may be recorded. 

No participant will be identified as the confirmed winner until winner verification has been completed. 

The confirmed winner may be invited to participate in publicity, photography, filming, interviews or related promotional activity. 

Any use of a winner's image, likeness, voice, comments or recorded content by Westpac will require appropriate consent and any required release documentation. 

Participation in publicity is voluntary unless otherwise agreed. 

11. Health and Safety 

Participants are responsible for their own safety and the safety of others. 

Participants must comply with all instructions provided by Westpac representatives, venue operators, event personnel and public authorities. 

Westpac may refuse participation, remove participants from the activation area or disqualify participants whose behaviour: 

• is unsafe; 
• is threatening, abusive or aggressive; 
• disrupts the event; or 
• creates risk to other participants or members of the public. 

12. Technical and Operational Issues 

Westpac is not responsible for delays, interruptions, technical failures, communication issues, transport disruptions, weather events or circumstances beyond its reasonable control that affect participation in the Competition. 

Westpac may amend Competition mechanics where reasonably necessary to ensure the safe and fair operation of the Competition. 

13. Privacy 

Westpac may collect, use and disclose personal information for the purposes of: 

• administering the Competition; 
• verifying eligibility; 
• contacting participants; 
• awarding prizes; 
• resolving disputes and complaints; and 
• meeting legal and regulatory obligations.   

Competition locations may be photographed, filmed or otherwise recorded. Where Westpac collects a participant's image, likeness, voice or recorded content, such information will be treated as personal information where applicable and handled in accordance with the Privacy Act 2020 and Westpac's Privacy Policy. 

Participants may be required to provide additional information and complete further privacy notices, consent forms or release documentation in connection with winner verification, prize fulfilment, photography, filming, publicity or promotional activities.  

Any use by Westpac of a participant's image, likeness, voice, comments or other recorded content for marketing or promotional purposes will be subject to any required consent and release documentation. Participation in such promotional activities is voluntary unless otherwise agreed by the participant.  

Personal information will be handled in accordance with the Privacy Act 2020 and Westpac's Privacy Policy, available at www.westpac.co.nz. Participants should only provide information reasonably requested for Competition administration, verification and prize fulfilment. 

14. Liability 

To the maximum extent permitted by law, Westpac is not liable for any loss, damage, injury or claim arising from participation in the Competition, except where liability cannot legally be excluded. 

Nothing in these terms limits any rights participants may have under New Zealand consumer laws. 

15. Disqualification 

Westpac may disqualify any participant who: 

• breaches these terms and conditions; 
• tampers with the Competition process; 
• acts fraudulently, dishonestly or unlawfully; 
• provides misleading information; or 
• behaves in a way that may damage the reputation of Westpac or the Competition.

16. Westpac Decisions 

All decisions made by Westpac regarding the Competition, winner verification, prize allocation and interpretation of these terms are final.
