What is changing in our Credit Card Conditions of Use?
A number of things have happened recently that mean we are updating the following conditions of use (each, the “Conditions of Use”):
- the Westpac MasterCard®, Visa and hotpoints American Express® cards,
- the conditions of use for the World MasterCard, and
- the conditions of use for the Westpac Titanium MasterCard and Westpac hotpoints Premium American Express cards.
The changes to the Conditions of Use will take effect from 1 July 2014.
Why are these changes being made?
1. American Express withdrawal
We are withdrawing the Westpac American Express® credit card programme from the market. From 12am on 1 July 2014, all American Express cards issued by Westpac New Zealand Limited will no longer be active. This will affect the following credit cards: hotpoints American Express cards, Westpac Gold American Express cards, and Premium American Express cards. To reflect these changes the relevant Conditions of Use are being refreshed to remove the references to American Express.
2. Changes to support the rollout of Westpac PayTag and new technology
We are constantly looking for ways to improve our credit card offerings. Westpac will shortly begin the roll-out of a new contactless technology option, Westpac PayTag, on its suite of credit cards. When available, Westpac PayTag will allow customers who choose to take this technology to be able to make payments by holding the Westpac PayTag close to the card reader at participating merchants. Changes are being made to the Conditions of Use to support the roll-out of this new technology. These changes include the introduction of a new term “payment instrument” to cover Westpac Paytag and other future methods of making payment from your credit card account.
3. Anti-money laundering and sanctions
The Anti-Money Laundering and Countering Financing of Terrorism Act 2009 requires us to collect extra information (including identity documents) from you or anyone who is acting on your behalf. We have re-worded the Conditions of Use to ensure that Westpac’s and your obligations under this Act are clear. We have included additional detail to the Conditions of Use to cover the situations in which we may be required to refuse to process a transaction involving a sanctioned country or that we otherwise consider to be suspect. You agree to provide to us all information necessary to enable us to manage our obligations in this area.
The Conditions of Use will be updated to ensure that we can comply with our Foreign Account Tax Compliance Act (FATCA) obligations. In particular, we have included privacy provisions in our Westpac Credit Card Conditions of Use that mirror those in our General Terms and Conditions.
We have clarified that Westpac will only be responsible for any amounts deducted from your account as a result of the failure of either your card or any ATM (excluding any card or ATM which is obviously faulty, or in the case of an ATM where it has been advised by notice or display as being faulty) to function properly. We have also made it clear that Westpac will not be liable to you for loss suffered by you if you have not complied with the terms and conditions for the relevant product or inserted items into ATMs that are not meant to go in them.
6. Right to Vary
We have simplified the clause relating to our right to vary the Conditions of Use and our products and services (including fees payable). At least 14 days’ notice of any changes will now be given in accordance with the Code of Banking Practice 2012.
7. Easier to follow
We have made a number of other changes with a view to making the Conditions of Use easier to follow. In particular, we have moved all of the definitions to the end of the Conditions of Use and grouped the sections relating to charges and interest under one heading.
